The former personal attorney for Donald Trump has left her position as the chief federal prosecutor in the state. This comes after a court battle that challenged her eligibility to occupy the role.
Official Departure
The head of the Justice Department, Pam Bondi, confirmed the prosecutor's departure on Monday. In a statement that the appeals court finding made it "untenable" for her to effectively run her office.
"Do not interpret compliance for surrender," Habba stated. "This battle will now stretch across America."
Judicial Challenge
The departure was triggered by a judicial panel ruled that she had been unlawfully serving as the federal prosecutor. This ruling is could influence scores of prosecutions in the Garden State.
The judicial panel declared that a interim role that bypassed Senate approval breached the Federal Vacancies Reform Act.
Ongoing Legal Battle
It was also stated that Habba will continue working within the Department of Justice as a high-level advisor. She will pursue additional appeals of the disqualification, aiming for a different outcome.
On a social media platform, the Attorney General wrote that the judiciary "should not be able to override the President's choice of lawyers responsible for performing the primary duty of the administration of enforcing the law."

Habba, originally became part of Donald Trump's lawyers in recent years. She later acted for the former president in his hush-money trial in 2024, when he was guilty verdict on dozens of charges of financial record manipulation.
Prior to assuming the role of US Attorney, the former president had stated he was appointing her as his senior adviser in a potential future term, labeling the lawyer as deeply loyal and a dedicated fighter for justice.
