Federal Court Mandates Freedom of Abrego Garcia from Immigration Detention

A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, concluding his continued confinement lacks legal authority.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The situation stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to answer alien smuggling allegations, he was held in federal detention.

In her order, the court pointed out that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The legal proceedings center on conflicting claims. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he vehemently denies this claim.
